1. General Conditions

These Terms and Conditions are created in accordance with the Consumer Protection Act, the Trade Act, and the Electronic Commerce Act. Our aim is to ensure a transparent and mutually satisfactory cooperation with every User.

These Terms govern all services we provide and define the rights and responsibilities of both parties. They apply to every contractual relationship unless stated otherwise in a separate agreement.

These Terms form an integral part of the Sale Agreement between you (“User”) and us (“Shop”). By using our website or making a purchase, you agree to these Terms.

Users must provide only the personal data necessary for accessing and using our services. For more details, please refer to our Privacy Policy.

You are not required to register an account to make a purchase. We do not actively monitor user-submitted content.

2. Services Offered

We offer the following services:

• Website as a Service (WaaS)
• WordPress themes (single product)

2.1 WaaS

When you subscribe to WaaS:

• You are granted usage rights but not ownership of the website.
• Themes from third-party providers are not allowed.
• If you cancel, your website cannot be transferred to another provider.

Included:

• Licensed use of provided photos (usable only during service period)
• 2 hours/month of customer support (each hour started counts as one hour)
• WordPress Theme
• Leads capturing plugin
• Booking plugin
• Optimized WordPress hosting
• SSL certificate
• Website installation

Pricing:

• Monthly: $67 (tax excluded), with a 6-month minimum term. After the minimum, you may cancel anytime using the termination link provided by email.
• Yearly: $737 (tax excluded), non-refundable. Cancel anytime to avoid renewal.

2.2 WordPress Themes (Single Product)

• Downloadable product with a license for one website only.
• Redistribution, resale, or modification of source code is not allowed.
• Includes all future updates.

3. Ordering & Contract Formation

To order a service, follow the checkout process and confirm payment.

• You will receive an Order Confirmation within 24 hours.
• A Purchase Contract is formed once we send a separate Confirmation email.

The Purchase Contract includes:

• Your order
• Order Confirmation
• Confirmation email
• These Terms and Conditions

Contracts are concluded in English. We are not obliged to provide services not confirmed via the Confirmation email.

4. Order Fulfillment

If your service cannot be delivered (e.g., due to incorrect email), we will attempt re-delivery. Contact us via [email protected] or the chat widget to resolve any issues.

5. Pricing and Payments

Prices are listed in USD, excluding VAT. Currency conversion differences may apply.

Accepted payment methods:

• Visa, MasterCard, Maestro, American Express
• Bank/Post transfer
• PayPal

Transaction fees are borne by the User.

Payment security is ensured via encrypted SSL protocols. We do not store card data.

Invoices are sent electronically. Printed copies are available on request for a postal fee.

Users must report missing invoices promptly.

6. Storage & Bandwidth

If you exceed your plan’s storage or bandwidth, we may bill you for the additional usage based on our pricing schedule.

7. Right to Withdraw

You have the right to withdraw from the purchase of a WordPress theme within 7 days.

• WaaS services are non-refundable.
• To withdraw, send a signed withdrawal statement to [email protected].
• Refunds are processed within 7 days using the original payment method.

8. Service Conformity

Services are considered conforming if:

1. They match the description/sample.
2. They are suitable for the intended purpose.
3. They meet general service expectations.
4. They function as reasonably expected.

Users may request corrections, a price reduction, or contract termination if services do not conform (unless the issue is minor).

9. Complaints

Complaints must be submitted within 8 days of service delivery or within 2 years for conformity issues.

To file a complaint:

• Submit a completed complaint form (provided with your Confirmation)
• Include evidence (photos, payment details, etc.)
• Send to [email protected]

We will confirm receipt within 48 hours and respond within 8 days with a resolution.

Incomplete, unclear, or unjustified complaints will be rejected.

10. Copyright & Ownership

• All software, materials, and methodologies remain our exclusive property.
• Unauthorized reproduction or modification of the service is prohibited.
• You may not redistribute, resell, or repurpose the service without our consent.

11. Confidentiality

Confidential information shared during the contract must be protected by both parties. This obligation continues after the contract ends.

12. User Responsibilities

Users are solely responsible for:

• Content accuracy
• Proper linking to third-party sites
• Ensuring no infringement of third-party rights

13. Dispute Resolution

Disputes may be resolved out of court (e.g., mediation or arbitration). Legal action remains available.

15. Limitations of Liability

We are not liable for:

• Service interruptions or slowdowns
• Unauthorized usage
• Financial losses
• Equipment incompatibility
• Force majeure or unforeseen events
• Service suspension or termination

16. Amendments

We may update these Terms at any time. Users will be notified at least 8 days in advance.

17. Effective Date

These Terms take effect on the eighth day after publication and apply from June 1, 2025.
